Member Terms and Conditions

1. Acceptance of Terms

The membership of ‘Delhi Daredevils Members Club’ is subject to the following Terms & Conditions ("TCM"), which may be updated, altered, modified or changed by Club from time to time without notice, and it constitutes each member’s full and unconditional agreement to the TCM.

2. Definitions

“Club” means ‘Delhi Daredevils Members Club’ owned by GMR Sports Private Limited. (“GMR”)
“Home Matches” shall mean the matches of IPL League played at Kotla Ferozshah Grounds involving Delhi Daredevil Team (“Home Team”)
“Membership” means membership of ‘Delhi Daredevils Members Club’ operated by the Club from time to time.
“Member” means a person who is granted membership of the Club subject to TCM.
“Stadium” means the club’s home ground at “Ferozshah Kotla Stadium”.

3. Member Registration Obligations

In consideration of grant of membership, members agree to: (a) provide true, accurate, current and complete information as required in Registration Form (such information being the “Registration Data”), and (b) maintain and promptly update the Registration Data to keep it true, current and complete. If any information is provided that is untrue, inaccurate, not current, or incomplete, or the Club has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, the Club has the right to suspend or terminate membership and refuse any and all current or future entitlements of the said member.

4. Club’s Privacy Policy

Registration Data and certain other information about members are subject to the Club’s Privacy Policy.

5. Eligibility and Approval

a. The membership of the Club is open only to individuals on a first-come-first serve basis.
b. Only a person of 18 years and above can become a member. However, children between the ages of 10 and 18 may become a member with the consent of their parent or legal guardian.
c. By becoming a member, you represent and warrant: (i) that you are atleast 18 years of age and agree to these terms, or (ii) that, as parent or guardian, you agree to these terms and our privacy policy and authorize your child to become a member, subject to your responsibility for their conduct.
d. Club, in its sole discretion, has the right to refuse membership to any person without assigning any reason.
e. A person is entitled to one membership of the Club. The Club will accept only one membership per person. If a single person joins (or attempts to join) more than once, or if the Club receives multiple membership applications from a single person, the Club reserves the right to cancel all applicable memberships, invalidate any home match tickets purchased under the applicable membership(s), and retain all membership fees paid as liquidated damages in order to cover the multitude of damages, costs and fees that the Club incur as a result of these forbidden activities.

6. Membership Tenure

The membership of Club is valid from April of one year to January (“Season”) of succeeding year. All memberships granted during the Season shall expire on 31st January next following. The renewal of membership for subsequent season is not automatic but is at the sole discretion of the Club upon the payment of non-refundable membership dues.

7. Membership Dues

The membership is conditioned upon payment by members of membership fee, service charges, and other fees and expenses, at the sole discretion of the Club. The Club reserves its right to increase the membership fee at any time, which increase shall not affect the existing members for their remaining term. However, the renewal of the membership shall be subject to payment of membership fee at current rates.

8. Conduct of Members

The Club reserves the right to discontinue the membership of any member who, as determined in the sole discretion of the Club, (i) is guilty of improper conduct, or (ii) uses the membership for improper, deceitful or unethical purposes or in a manner inconsistent with the TCM or any laws, or (iii) acts (a) in an unsportsmanlike manner, (b) with an intent to annoy, abuse, threaten, or harass the Club or any other person, or (c) in any other disruptive manner, or (d) in a manner which is consistent with the terms and conditions of match ticket terms. Discontinued membership may result in the loss of all benefits and privileges. A Member terminated in this manner shall not be entitled to a refund of their membership fee. In addition to discontinuance of membership or participation, the Club shall have the right to take appropriate administrative and legal action, including criminal prosecution, as it deems necessary in its sole discretion.
No Member shall attempt, directly or indirectly, to undermine, disrupt, hinder, or interfere with the proper operation of the Membership Program (“Program”) in any manner whatsoever.
Membership and its privileges are for lawful purposes only. Any conduct by a Member that, in the Club’s discretion, restricts or inhibits any other Member from using or enjoying the Membership will not be permitted. Member shall not use membership in the Program to advertise or perform any commercial solicitation. Should a Member violate these or other restrictions, the Club reserves the right, in addition to termination of privileges as set forth herein, to seek damages and other remedies from any such person to the fullest extent permitted by law. The Club’s failure to enforce any of these Terms and Conditions shall not constitute a waiver of that, or any other, provision.
All questions or disputes regarding an individual’s eligibility for the Membership or a Member’s compliance with these Terms and Conditions will be resolved by the Club in its sole discretion.

9. Modification and Termination

The Club may modify any of the terms and conditions governing the Program including, but not limited to, Program eligibility requirements, application and enrollment procedures, applicable Member dues or charges, applicable Member benefits or privileges, the TCM, and any other applicable rules, guides, terms, or policies pertaining to the Program (including, without limitation, the Program Guides) - at any time, with or without notice, even though these changes may affect a Member’s status or other rights, benefits, or privileges under the Program.
A Member’s continued participation in the Program constitutes that individual’s acceptance of any changes to the TCM. Members are responsible for remaining knowledgeable as to any changes that the Club may make to the TCM. The most current version of these Terms and Conditions will be available on the Club’s official website pertaining to the Program and will supersede all previous versions of these Terms and Conditions.

10. Membership Card

Each member shall be issued a membership card, which shall, at all times, remain the property of the Club. The membership card must be produced for inspection or verification on demand by any official or employee or duly authorized agent of the Club. If a Member loses or misplaces his/her Membership card, or has it stolen, he/she should report such fact to the Club as soon as possible. The Club may issue the duplicate Membership card on such terms and conditions as the Club may require, upon a charge of fee for issue of any duplicate Membership card, which may be varied at the sole discretion of the Club from time to time.

11. Non-transferable

The membership is personal. The membership and membership card are strictly non-transferable. The benefits of the membership are also non-transferable except as may be expressly permitted by the Club.

12. Entitlements

The membership does not automatically guarantee the tickets for home matches. A member may be entitled to certain membership benefits, which may include the entitlement to purchase the tickets of home matches on first-come-first-serve basis at a special discount. The entitlement to purchase such tickets is not guaranteed and shall be subject to availability and shall be restricted to purchase of two tickets of the members stand at a special discount of 25% of the face value of ticket (excluding applicable taxes). The Club, at its discretion, may permit, subject to availability on a first-come-first-serve basis, two additional tickets, up to a maximum denomination of rs.6,000/- at a discount of 10% of the face value of the ticket (excluding applicable taxes).

13. Breach of Terms

All members and their guest(s) shall at all times observe the home match ticket conditions. The Club reserves the right to cancel the membership and membership card of any member, without any compensation, who is or whose guest(s) is/are ejected from the ground for breach of these terms or the home match ticket conditions. Any breach of these terms and conditions by any member shall entail refusal of his or her entry to the ground for any home match, without any compensation.

14. IPL Rules & Regulations

The membership of Club is subject to IPL rules and regulations. The vailability of home match tickets will be declared by the Club on per match basis in accordance with IPL ticketing policies.

15. Force Majeure

The Club shall not be liable to any member or any third party for failure or delay in performance of its obligations if such failure or delay is due to circumstances beyond its reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, terrorism, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation and failure of third party or inability to obtain supplies.

16. Entire Agreement

These terms and conditions and any associated Registration/Application form/process shall constitute the entire agreement between the Club and the Member in relation to the ‘Club Membership’.

17. Severability

If any of these terms and conditions is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such terms and conditions shall, to that extent, be severed from the remaining terms and conditions which shall continue to be valid to the fullest extent permitted by applicable laws.

18. Disputes

All disputes arising out of or relating to the membership of the Club are subject to Delhi Jurisdiction only. The club’s performance under this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of the Club’s right to comply with governmental, court and law enforcement requests or requirements relating to membership or information provided to or gathered by the club with respect to such use.
